Program coverage

Public liability insurance

This insurance can help protect you against the financial risk of being found liable to a third party for death or injury or loss of or damage to property resulting from your negligence.

Product liability

This insurance can help cover legal costs and any compensation payable if a product you supply, sell or recommend - such as equipment or workout aids - causes a client or third party injury or property damage.

Professional indemnity

This insurance is designed to help pay legal costs and any compensation payable if a client or third party claims your advice, training program or services caused injury, illness, lost earnings or other financial loss.

Who’s covered

Eligible AUSactive members who have selected the insurance add on at their membership application or renewal.

Public liability

$20,000,000 limit on any one occurrence.

Product liability

$20,000,000 any one occurrence and in the aggregate.

Professional indemnity

$10,000,000 any one claim and in the aggregate.

What’s not covered

High-risk activities

Claims arising from activities such as combat sparring and rock climbing are not covered. Please refer to your AUSactive Exercise Professionals Policy Schedule and Policy Wording for full details of excluded activities.    

Vehicles

Use of business vehicles, as well as aircraft, hovercraft, watercraft or related products.

Workplace injuries

These include injuries to your employees. Generally, workplace injuries are not covered under public liability insurance – these may be covered under workers compensation cover.

Slimming products

Use of metabolic drugs or slimming products.

Specified activities

Some sporting activities are also excluded from this policy, including some contact sports as well as hazardous activities. For a comprehensive list, read the policy document on this page.

Covered fitness activities include, but are not limited to the following:

  • Personal training
  • Promotion of fitness, health and associated activities
  • Boxing / Cardio kickboxing (non-contact)
  • Crossfit
  • Pilates / Barre
  • Les Mills
  • Online Operations
  • Yoga
  • Pre/ post-natal training
  • Mums & Bubs Classes
  • Aqua Aerobics
  • Fitness related Product Sales
  • Generic nutrition advice

  • Exercise Professionals operating as a company, partnership or trust.
  • Activities unconnected with the Insured's personal scope of practice and/or qualifications from a Tertiary or Registered Training Organisation unless specifically agreed.
  • Exercise professionals who are owners/operators of commercial fitness facilities conducting unsupervised activities to a membership base.
  • Exercise professionals who have employees or more than 3 subcontractors at any one time.
  • Exercise Professionals who are operating from their residence/a home studio.
  • Exercise professionals who sell and/or hire fitness machinery.
  • Any swimming instruction by swim teacher and/or coaches except aqua exercise instruction.
  • Any activities involving cargo nets.
  • Any Martial Art activities involving contact or combat.
  • Any activities involving hiking or trekking.
  • Any Training of Professional Sports Persons whose personal income is derived from the participation in sporting activities, unless this income is below AUD 25,000 within a 12 month policy period.
  • Any other activities excluded in section 21 & 22 of the AUSactive Exercise Professional Policy Wording 2025.

Minimum of a certificate 3 or 4 in fitness from:

  • an Australian registered training organisation.
  • New Zealand training body.
  • South African training body.
  • British/Irish training body.

And must have written risk management procedures for the below:

  • First aid.
  • Blood spillage and infectious disease.
  • Inspection of equipment.
  • Emergency procedures in event of serious injury.

Training pregnant clients.

The AUSactive exercise professional insurance policy arranged by Marsh can cover you Australia-wide.

Depending on your business, Marsh can arrange cover for a variety of venues – including gyms, parks, hired spaces and your client’s home.

This insurance covers:

  • Sole traders.
  • Employees.

Marsh can still arrange other insurance for the following :

  • Company.
  • Training clients physically from own residence.
  • Trust/Partnership.
  • Mobile trainers.
